Signing a Settlement Agreement with DocuSign

This guide will help you understand how to a Settlement Agreement with DocuSign electronically.

Your platform enables you to sign documents created within a web conference with DocuSign. This can be one of the pro-forma settlement agreements we have built into the platform or a free-form document you may have co-drafted while in the conference. Your parties can sign the agreements all within the conference or also have the option to review the document once the conference is complete and sign it at a later date.

The platform is connected to Immediation's DocuSign account. There is no need to purchase your own DocuSign subscription to use the DocuSign Module within Immediation. The use of DocuSign is bundled as part of your Immediaiton subscription. If you wish to connect your own DocuSign account to Immediaiton contact support@immediaiton.com.

Your platform has pre-defined settlement agreements that you can use to create your own. You can find them in the proforma tab inside a web conference.





The platform offers two versions of the settlement agreement that you can use. The one available to you depends on whether you are domiciled in the US and Canada or Australia and New Zealand.



Schedule 1 on page 9 and the Execution Page on page 10 is what we can help you complete in the Settlement agreement module.



Creating and Signing a Settlement Agreement



1) Click on Settlement Agreement on the right-hand side.





2) Select a scribe to draft the terms in Schedule 1.



2) Select the signatory who needs to sign the agreement. Click on "New Signee" to add to the number of signatories. There needs to be at least one signatory.

Signatories must be listed as participants in a meeting to be selected as signatories to the agreement. If you need a signatory who is not a participant of the web conference to sign the agreement, you will still need to add them as a participant in the conference, although they don't have to attend. For example, this might be the company secretary or financial controller. Although they might not need to be present at the mediation, they may have to sign the Settlement Agreement. All signatories will receive an email notification with the ability to log in to the platform to sign the document outside the web conference once it is complete. This limitation of the current DocuSign integration will be addressed in future platform releases.





3) Fill out the terms corresponding to Schedule 1 of the agreement.

If, in a previous conference, you created a Settlement Agreement but did not execute it, then these fields will be pre-completed based on the earlier version. You can modify the terms that were changed to save yourself time from retyping them again.



4) Click on "Finish Terms & Request Signatures". This will send an email notification to the signatories and allow them to sign via DocuSign.

1) As the Mediator, you will be able to preview or update the terms of the settlement agreement's execution version.



2) Click on "Preview Document" to see the terms in Schedule 1 updated to reflect what was completed during the conference.





3) You can see the following status changes as the signatories sign the document.





4) If you end the conference, you will be able to see the execution version of the settlement agreement in the Docusign Tab in MyMatters..



5) You will also have the option to preview or void the execution version as you did inside the web conference.



6) You will see this screen Once all the signatories have signed the document.



7) Click on "Download Settlement Agreement" within the conference to view the executed version.





8 ) The executed version of the settlement agreement will also be available in the Docusign tab in MyMatters.

1) During the conference, document signatories will have the option to electronically sign the document via DocuSign.





2) You will also get an email notification that a document is waiting for your signature. This is useful if you sign the settlement agreement but are not attending the conference.



3) You can see the execution version of the settlement agreement in the Docusign tab of MyMatters. This might be when all parties have created the settlement agreement within a conference but require time to review the document after completion.



4) You will also have an option to sign the document outside the web conference.



5) Once all parties have signed, You will also see the executed version of the settlement agreement in the Docusign tab in MyMatters.
